TERMS AND CONDITIONS
Welcome to BRITO CRM, thank you for taking the time to review the following Policies, Terms and Conditions listed below for all Marketing services we offer to our clients.
COMPENSATION
Payment in advance is required for all services. Customer agrees to make payment for all “One Time Services” in advance, either by purchasing directly on our website, or by our online payment method, in order to begin any service. The Client agrees to pay for the “Monthly Services” by automatic credit card transactions. Invoices will include the monthly fees and any additional fees for any additional services purchased by the Customer. Invoices will be issued and automatic transactions will be processed on the Renewal Date. Brito Marketing reserves the right to assess and charge late fees of 1.5% per month on overdue balances.
SERVICE CANCELLATION POLICY
Either party may terminate the service with or without cause upon thirty (30) days prior written notice. All services rendered in advance will be charged in the event of early termination. 100% or partial refund if we have not fulfilled our obligations to deliver the work required under the agreement. See Refund Policy below.
Brito Marketing reserves the right to cancel any agreement on abandoned or inactive projects for more than 30 days with or without prior notice.
REFUND POLICY
100% reimbursement will only be made in case of cancellation within 3 days after the initial contract is signed. All sales are final. A project can be divided into monthly payments as a courtesy to the client. Once a payment or deposit has been made, it is non-refundable.
All digital marketing packages including Social Media are non-refundable, but the client may cancel with 30 days written notice. Please read the Cancellation Policy above.
We do not offer any refunds for services already delivered, initiated, or any other charges that are not recoverable for Brito Marketing. No refunds will be given once the initial project has been delivered. There are no partial refunds for projects in the middle of a milestone phase.
There are no refunds or credits of any kind for Search Engine Optimization (SEO), Pay-Per-Click (PPC), Social Media Marketing (SMM), Email Marketing, or any other third party online marketing services, even if a fee was paid in advance. Once payment is made, there are no exceptions to our refund policy.
Web design and development requires extensive resources and incurs internal costs. Therefore, once a payment or deposit is made, it is non-refundable. The hosting fee is non-refundable.
We do not offer deposit refunds or payments for abandoned or inactive projects. If you have contracted our services but have not used them, you still have the right to pay us.
All billing cycles for the agreed services will continue until The Customer sends a written cancellation notice. Please read the Cancellation Policy above.
COMPLETION OF WORK
In the event that the Client is late in providing us with content, images, videos or any other material that causes a delay in the completion of the work, Brito Marketing has the right to extend the previously agreed deadlines by a reasonable amount. Read Project Delays for more information.
Brito Marketing reserves the right to cancel any agreement on projects that are abandoned or remain inactive for more than 30 days with or without notice.
CONTENT MATERIALS
Customer must provide all content materials required by us to complete the work. Such materials may include, but are not limited to, written copy, logos, images, videos and other printed material. Brito Marketing is not responsible for any copyright infringement caused by materials submitted by the Client. We reserve the right to refuse any copyrighted material unless proper proof of authorization to use such material is provided.
For all Copywriting Services (Content Optimization, Web Copywriting, Blog Writing, Press Release Writing, Product Description, etc.), Brito Marketing will prepare Content Materials that correspond to the project set by the Client in terms of page count, word count, keywords and style. The Client will receive an initial draft for approval prior to the finalization of all Content Materials. Once the initial draft is approved, Brito Marketing will complete all additional Content Materials (web pages, articles, blogs, press releases, etc.) The Client will then have 2 additional revisions to provide changes and final approval.
DOMAIN NAMES AND WEB HOSTING
Hosting and domain are not included in the Web Site Design or Development service. The Client is responsible for obtaining their own domain and hosting through us or a third party company of their choice. Brito Marketing can provide the client with account credentials for domain name registration and/or web hosting. Please read Additional Costs for more information.
REVIEWS
We are pleased to offer you the opportunity to perform 2 major reviews of each project we do in our agency…
Websites: Our website development phase is flexible and allows for certain variations from the original specification. However, any major deviation from the approved design will be charged at the rate of $175.00 USD per hour.
PROJECT DELAYS, CLIENT RESPONSIBILITY AND APPROVALS
Any deadline or estimate we give is contingent upon your full cooperation and the complete and final photographic content of the work pages.
During development, some feedback is required in order to progress to later phases. You need to designate a single point of contact who is available on a daily basis to streamline the feedback process.
If the Client fails to provide content materials, images or any other information that causes a delay of more than 3 days in the project, there will be a 30-day waiting period to reinstate your project to the pipeline.
Once the work is completed, you will be notified and will have the opportunity to review it. Nothing will be published without your approval. You must notify us in writing of any unsatisfactory points within 7 days of such notification.
Once the final review has been approved, the work cannot be rejected at a later date and the contract will be considered finalized. The client will receive the website files, usernames and passwords for their website.
GUARANTEE ON THEIR PART AS TO THE OWNERSHIP OF INTELLECTUAL PROPERTY RIGHTS
The customer must obtain all necessary permissions and authorities regarding the use of all copy, graphic images, registered company logos, trade names and trademarks, or any other material supplied to us.
Brito Marketing shall not be liable for any claim or legal action related to the content, graphic images, videos, logos, company names and trademarks, or any other material provided to us for your website.
LICENSE
Once the website is published, Brito Marketing grants the customer a license to use the website and the software and related content for the lifetime of the website.
NON DISCLOSURE
Brito Marketing (and any subcontractors it hires) will at no time disclose any information that is proprietary to the customer and will protect such information as confidential.
ADDITIONAL COSTS
Customer will reimburse Brito Marketing for any additional expenses, including but not limited to the purchase of templates, third party software, stock photography, fonts, domain name registration, web hosting or similar expenses.
